5.1 Notice and Consent Obligations
As a user of The Lead Marketplace’s platform, you are solely responsible for obtaining all necessary notices, consents, and permissions from prospects before collecting, storing, or sharing their personal information, including recordings. You must ensure that prospects are fully informed about how their data will be used, including its sharing with third parties.
5.2 Indemnification and Liability
By using The Lead Marketplace ‘s Services, you agree to indemnify, defend, and hold harmless The Lead Marketplace LLC, its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from and against all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your failure to obtain the necessary consents or your violation of applicable data protection laws.
5.3 Data Removal Requests
If a prospect requests the removal of their personal information from the The Lead Marketplace platform, you are responsible for notifying The Lead Marketplace immediately. Upon receiving such notification, The Lead Marketplace will take reasonable steps to remove the prospect’s data from our platform within a reasonable timeframe. However, The Lead Marketplace is not responsible for any failure to comply with such requests that arises from your delay or failure to notify us.
6. Processing of User-Submitted Lead Details
6.1 Anonymization of Lead Details
To protect the privacy of prospects, The Lead Marketplace keeps lead details anonymous for as long as possible during the transaction process. For appointments, the address of the prospect is revealed to the buyer 30 minutes before the scheduled appointment time. The prospect’s contact information is revealed at the time of the appointment. For leads, contact details are revealed to the buyer only upon purchase.
6.2 Commitment to User Anonymity
The Lead Marketplace is committed to maintaining the anonymity of its users throughout the process. Users will not see other users’ usernames, personal information, or reviews. All communications between buyers and sellers regarding leads or appointments are facilitated through our support chat or email. If a buyer has a question about a lead, it will be communicated through our support team to protect both the buyer’s and the seller’s identities.
7. Purposes and Legal Basis for Data Processing
We process your setter-submitted lead information only after it has been submitted to the marketplace and only in ways that fulfill the business purposes of the platform. While we have put processes in place to avoid platform contact with prospects, when necessary and applicable, we may use setter submitted lead information to contact the prospect. Outside of the following circumstances, users will be given explicit notice when we are required to contact their prospect:
- Lead Information Verification: We employ third-party verification services, but in the event of a buyer dispute, we may contact the prospect to verify the accuracy and validity of the lead information provided. This step ensures that the details submitted are correct and actionable, reducing the risk of incorrect data being used in transactions.
- Consent and Appointment Verification: If the lead involves a scheduled appointment, we may reach out to the prospect to confirm their consent and availability. This is necessary to ensure that the appointment is legitimate and that the prospect is fully aware of the meeting.
- Marketplace Presentation: We use anonymized lead contact information to present and display the lead on the marketplace to potential buyers. This includes most setter-provided information about the lead that helps buyers make informed decisions without revealing sensitive contact details until necessary.
- Transfer to Winning Buyer: Once a lead is purchased, the prospect’s contact information is disclosed to the winning buyer at the appropriate time, as detailed above in section 6.1. This is essential to enable the buyer to engage with the prospect as per the lead’s terms.
- Information Removal: If a prospect requests the removal of their information from the platform, we may contact them to confirm the request and notify them of the actions taken. This is crucial to ensure that we comply with their request and that their information is removed from all relevant areas of the platform.
- Disposition Verification: For leads with appointments, we may contact the prospect to verify the user submitted disposition of the lead after the appointment or transaction has occurred. This helps to prevent any fraudulent activity.
- Inactivity: If there is a period of inactivity concerning the lead lasting more than six (6) months, The Lead Marketplace reserves the right to contact the prospect for the purpose of setting an appointment and re-posting them as a lead for sale on the marketplace. In this event, the original setter will be compensated at a reduced rate to be determined by the platform.
We process your personal data based on several different legal bases, depending on the purpose of the processing. These include:
- Contract Performance: To fulfill our contractual obligations to you, such as providing access to our Services, facilitating transactions, and processing payments.
- Legitimate Interests: For our legitimate business interests, such as improving our Services, enhancing security, and preventing fraud, provided that such interests are not overridden by your rights and interests.
- Legal Obligations: To comply with legal obligations, such as maintaining records for tax, accounting, and auditing purposes, and complying with law enforcement requests.
